Terms of Use

These Terms of Use ("Terms") govern your use of the US Citizenship Test mobile application (the "App", "Application") and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1) Educational Purpose / No Government Affiliation

The Service is an independent, third-party educational tool designed to help users practice for the U.S. naturalization civics test.

2) No Guarantee of Results

• Your results depend entirely on your own preparation, knowledge, and performance during the actual test.
• USCIS may change test questions, procedures, or requirements at any time without notice to us.
• The Service Provider assumes no responsibility for the outcome of your citizenship application or test.
• Use of this app does not create any relationship with USCIS or affect your immigration case in any way.

3) Content Accuracy and User Responsibility

• Content may be outdated: Test questions, answers, and related information in the app may become outdated as USCIS updates its materials. We make reasonable efforts to keep content current, but we do not guarantee accuracy or timeliness.
• Elected officials change: Information about elected officials (President, Vice President, Senators, Representatives, Governors, etc.) may be outdated due to elections, appointments, resignations, or deaths. Always verify current officials through official government sources before your test.
• User's duty to verify: It is YOUR responsibility to check the official USCIS website and study materials for the most current and accurate test content before your naturalization interview.
• No liability for outdated content: The Service Provider is not liable for any consequences resulting from outdated, inaccurate, or incomplete information in the app.
• Translations: Parts of the app are available in languages other than English — the app's own screens, the civics questions and answers, and the N-400 interview-preparation material. These translations are produced with the assistance of artificial intelligence and reviewed before release. They are provided as a study aid to help non-English speakers understand the content. They are NOT official USCIS translations and may contain errors or omissions.
• English is the authoritative version: The English version of all content in the app is the authoritative version and controls in the event of any discrepancy with a translation. Where a translation and the English text differ, the English text is correct. You are responsible for verifying any information that affects your application against official USCIS materials at uscis.gov or with a licensed attorney.

4) No Legal Advice

The Service provides general educational information and practice tools. It does not provide legal advice and does not replace guidance from USCIS, immigration attorneys, legal professionals, or accredited representatives. For legal questions about your immigration case, consult a qualified professional.

5) Eligibility

You must meet the minimum age requirement in your jurisdiction to use the Service:

• United States: You must be at least 13 years old.
• European Economic Area, UK, and Switzerland: You must be at least 16 years old (or the applicable age of digital consent in your country).
• Other jurisdictions: You must meet the minimum age required by local law.

If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian to use the Service.

6) Subscription, Billing, and Cancellation

The App offers an optional premium subscription ("Pro") that removes advertisements and unlocks AI-powered features including AI Mock Interview and AI-assisted reading practice. Subscriptions are available in weekly, monthly, and yearly plans. All subscription transactions are processed entirely by Apple (App Store) or Google (Google Play).

• Payments: All payments are processed by Apple App Store or Google Play. We do not have access to your payment card details and do not process payments directly.
• Subscription management: Subscriptions are managed through RevenueCat, a third-party subscription management service.
• Auto-Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation: You can cancel anytime through your device's subscription settings (App Store → Subscriptions or Google Play → Subscriptions). After cancellation, you retain access until the end of the current paid period.
• Refunds: All refund requests must be submitted to Apple or Google, as they control billing. We cannot process refunds directly. Refund eligibility is determined solely by Apple/Google under their respective policies.
• EU Right of Withdrawal: If you are in the European Economic Area, you have a 14-day right of withdrawal for digital purchases. However, by starting to use the subscription immediately after purchase, you acknowledge that you lose this right of withdrawal once the digital content has been fully provided. Apple and Google may offer their own refund processes which you can use within their policies.
• Restore Purchases: If you reinstall the app or switch devices, use the "Restore Purchases" feature to restore your subscription.
• No partial refunds: We do not provide partial refunds for unused subscription time.
• Price changes: Subscription prices may change. You will be notified through the App Store or Google Play before your next renewal.

7) Internet Connection Requirements

Certain features of the free (ad-supported) version of the Service require an active internet connection to display advertisements. The ad-free subscription allows access to core study features without requiring an internet connection. AI-powered features (AI Mock Interview, AI reading practice) always require an active internet connection.

7a) AI-Powered Features

The premium subscription includes AI-powered features that use third-party artificial intelligence services (OpenAI) for speech-to-text transcription and answer evaluation. By using these features, you acknowledge and agree that:

• Usage limits: AI features are subject to a daily usage limit set by us, to ensure fair usage and manage costs. The limit is measured in AI-checked questions and transcription calls, not sessions, and separate limits apply to different AI features. This limit may change, and it may be increased or decreased at any time at our sole discretion, without prior notice.
• Audio processing: Your spoken audio is sent to our server and forwarded to OpenAI for transcription. Audio is processed in real time and is not stored after transcription.
• AI accuracy: AI transcription and evaluation are not perfect. Results may contain errors, especially with strong accents, background noise, or unclear speech. AI feedback is for practice purposes only and does not reflect how a real USCIS officer would evaluate your answers. You should not rely solely on AI evaluation to gauge your readiness for the actual test.
• No guarantee of availability: AI features depend on third-party services (including but not limited to OpenAI, Supabase, and Upstash) that may experience outages, degraded performance, rate limiting, changes, or discontinuation at any time. We do not guarantee any specific level of uptime, availability, or response time for AI features. Temporary or extended unavailability of AI features does not entitle you to a refund or credit. The non-AI portions of the Service (study materials, flashcards, practice questions) remain available regardless of AI feature status.
• Service modification: We reserve the right to modify, suspend, limit, or discontinue any AI-powered feature at any time, with or without notice, for any reason including but not limited to: managing costs, responding to abuse, third-party service changes, security incidents, or business decisions. Such changes do not constitute a breach of these Terms.
• Acceptable use: You agree not to use AI features for any purpose other than personal citizenship test preparation. You agree not to attempt to bypass usage limits, exploit the service, or use automated tools to interact with AI features.
• Session tracking: We track AI session usage on our server to enforce daily limits and prevent abuse. See our Privacy Policy for details on what data is stored.

8) User Content and Feedback

If you submit feedback, suggestions, or other content to us (e.g., by email), you grant us permission to use it to improve the Service without obligation to you. Do not submit sensitive personal information via feedback channels.

9) License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use.

You agree NOT to:

• Use the Service for any unlawful purpose;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application;
• Modify, adapt, translate, or create derivative works based on the Application;
• Copy, distribute, or publicly display the Application or its content (except as permitted);
• Remove, alter, or obscure any copyright, trademark, or proprietary notices;
• Interfere with or disrupt the Service or servers;
• Use automated means (bots, scrapers, etc.) to access the Service;
• Misrepresent your identity or your relationship to any government entity;
• Attempt to circumvent any security features, rate limits, session limits, or access restrictions;
• Abuse, exploit, or make excessive use of AI-powered features beyond normal educational use;
• Use spoofed identifiers or forged requests to access premium features without a valid subscription.

10) Intellectual Property

The Service and its original content (excluding public-domain government materials) are owned by the Service Provider and protected by applicable intellectual property laws. USCIS materials and other government content remain the property of their respective owners and may be subject to public-domain rules.

11) Third-Party Services and Data

The Service relies on third-party services and data sources. Your use of the Service is also subject to the terms and privacy policies of these providers:

• Subscription Management (RevenueCat): Handles subscription entitlements and purchase verification.
• Advertising (Google AdMob): Displays advertisements in the free version. Ads may be personalized based on your consent. You can manage your ad preferences in Settings → Privacy Settings.
• Platform Services: Apple App Store and Google Play Services process payments and provide core functionality.
• Government APIs: The elected officials feature uses public APIs from Congress.gov, the U.S. Census Bureau, HUD, and other sources. Data from these sources may be delayed, incomplete, or inaccurate. This product uses the HUD User Data API but is not endorsed or certified by HUD User.
• AI Services (OpenAI): AI Mock Interview and reading practice features use OpenAI's APIs for speech transcription (Whisper) and answer evaluation (GPT). OpenAI processes data under its Terms of Use.
• Backend Services (Supabase): Session tracking and usage limits are managed through Supabase's cloud infrastructure.

We are not responsible for the availability, accuracy, or content of any third-party services. Third-party services may experience outages, errors, or discontinuation without notice.

12) No Maintenance or Support Obligation

The Service Provider is not obligated to provide maintenance, technical support, or updates for the Application. Any maintenance or support provided is at the sole discretion of the Service Provider.

13) Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service Provider expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses;
• Any warranty regarding the accuracy, completeness, reliability, or timeliness of any content, including test questions, answers, or elected official information;
• Any warranty that using the Service will result in passing the citizenship test or any other desired outcome.

You use the Service at your own risk. The Service Provider does not warrant that the app content matches current USCIS test materials.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service Provider shall NOT be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses.
• The Service Provider shall NOT be liable for any damages arising from: (a) your use or inability to use the Service; (b) any failure to pass the citizenship test or any immigration-related outcome; (c) outdated, inaccurate, or incomplete content; (d) unauthorized access to your data; (e) any third-party conduct or content; (f) any interruption, suspension, or cessation of the Service or any feature thereof, including AI-powered features; (g) any cyberattack, security incident, or service disruption affecting the Service or its third-party providers; (h) any changes to usage limits, features, or pricing.
• The Service Provider's total cumulative liability for all claims arising from or related to the Service shall not exceed the greater of: (i) the amount you actually paid for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) ten dollars ($10.00 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, liability is limited to the fullest extent permitted by applicable law.

15) Assumption of Risk

By using the Service, you acknowledge and agree that:

• You understand the Service is a study aid only and does not guarantee any outcome;
• You are solely responsible for your citizenship test preparation and results;
• You will verify all information with official USCIS sources before your test;
• You assume all risks associated with using the Service, including reliance on potentially outdated content;
• The Service Provider has no control over USCIS policies, test content, or immigration decisions.

16) Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Service Provider and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any claim that your use of the Service caused damage to a third party.

Note for EU/EEA consumers: This indemnification clause applies only to the extent permitted under applicable consumer protection laws in your jurisdiction.

17) Dispute Resolution and Arbitration

For Users Outside the European Economic Area, UK, and Switzerland:

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

• No Class Actions: You and the Service Provider agree that any Dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
• Arbitration Rules: The arbitration will be administered by JAMS or another mutually agreed arbitration provider under its applicable rules. The arbitration will take place in California, USA, unless another location is mutually agreed upon.
• Costs: Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.
• Opt-Out: You may opt out of this arbitration agreement by sending written notice to sendfeedbackus@gmail.com within 30 days of first using the Service. If you opt out, you may pursue claims in court.

For Users in the European Economic Area, UK, and Switzerland:

The arbitration provisions above do not apply to you. You retain your right to bring any dispute before the competent courts. Nothing in these Terms limits your rights under applicable EU consumer protection laws, including the right to seek remedies in the courts of your country of residence.

For EU consumers: You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes online.

18) Governing Law

These Terms and any Dispute shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

For users outside the EEA, UK, and Switzerland: If arbitration is not applicable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in California.

For users in the EEA, UK, and Switzerland: This choice of law does not deprive you of the protection of the mandatory consumer protection provisions of your country of residence. You may bring legal proceedings in the courts of your country of residence or in the courts of California.

19) Legal Compliance

You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

20) Third-Party Beneficiaries

Apple Inc. and Google LLC and their subsidiaries are third-party beneficiaries of these Terms with respect to the Application distributed through their respective platforms. Upon your acceptance of these Terms, Apple and Google will have the right to enforce these Terms against you as third-party beneficiaries.

21) Termination and Data Deletion

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for compliance or security reasons. Upon termination, your license to use the Service is revoked. You may stop using the Service at any time by uninstalling the App.

Data deletion: You can delete your server-side data (AI session records) at any time through the "Delete My Data" option in the app's Settings screen. We delete your personal data from our servers immediately upon request. To prevent abuse, a minimal pseudonymous record of daily usage counts (no personal content) is retained for up to 10 days after deletion, then automatically purged. For data held by third-party services (RevenueCat, Apple, Google), please contact them directly. See our Privacy Policy for full details.

22) Force Majeure

The Service Provider shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions or orders, war, terrorism, cyberattacks (including DDoS attacks, hacking, or unauthorized access), third-party service outages or failures (including but not limited to OpenAI, Apple, Google, Supabase, Upstash, RevenueCat, or any cloud infrastructure provider), internet service disruptions, power outages, labor disputes, or any other event beyond the Service Provider's reasonable control.

During any period of force majeure, the Service Provider's obligations are suspended without liability. If a force majeure event continues for more than 30 consecutive days, either party may terminate these Terms without penalty.

23) Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

24) Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Service and supersede all prior agreements and understandings.

25) Changes to the Service or Terms

We may update the Service and these Terms from time to time. We will notify you of material changes through the app or other appropriate means. Your continued use of the Service after any changes means you accept the updated Terms.
